REGISTRATION OF MARK
Part One
Substantive Examination
Article 18
- The Directorate General shall conduct a substantive examination of the application not later than30 (thirty) days after the receipt date as referred to in Article 15.
- Substantive examination as referred to in paragraph (1) shall be conducted based on stipulation in Article 4, Article 5, and Article 6.
- Substantive examination as referred to in paragraph (1) shall be completed not later than 9 (nine) months.
Article 19
- The substantive examination shall be conducted by examiners of the Directorate General.
- The examiner who have skill and qualification shall hold functional position, who are appointed and discharged by the Minister on the basis of certain requirements.
- The examiner shall be given functional degrees and allowances besides other rights pursuant to the law in force.
Article 20
- In the case the examiners come to the conclusion that the application can be approved to be registered, the Directorate General shall announce said application in the Official Report on Marks.
- In the case the examiners come to the conclusion that the application can not be approved to be registered, the Directorate General shall inform the applicant or proxy in writing stating the reasons.
- The applicant or proxy shall be entitled to lodge protest or opinion in writing stating the reasons not later than 30 (thirty) days after receipt of disapproval letter as referred to in paragraph (2).
- In the case the applicant or proxy didn’t lodge protest or opinion as referred to in paragraph (3), on Directorate General approval, the Application shall be rejected.
- In the case the Applicant or Proxy lodged a protest or opinion as referred to in paragraph (3), and the examiner report that said opinion is acceptable, on Directorate General approval, the Application shall be announced in the Official Report on Marks.
- In the case the Applicant or Proxy lodged a protest or opinion as referred to in paragraph (3), and the examiner report that said opinion is unacceptable, on Directorate General approval, the Application shall be rejected.
- Rejection decision as referred to in paragraph (4) and paragraph (6) shall be informed in writing to the Applicant or Proxy stating the reasons.
- In the case the application is rejected, all expenses already paid to the Directorate General cannot be withdrawn.
